1. Introduction

Welcome to Bookify (“Company”, “we”, “our”, “us”).

These Terms of Service (“Terms”) govern your use of our website Bookify.digital and any related software, mobile applications, and online platforms (collectively, the “Service”).

Our Privacy Policy also governs your use of the Service and explains how we collect, safeguard and disclose information resulting from your use of our web pages.

Your agreement with us includes these Terms and our Privacy Policy (“Agreements”). By using the Service, you acknowledge that you have read, understood, and agree to be bound by the Agreements.

2. Communications

By using our Service, you agree we may send you newsletters, marketing or promotional materials and other information. You may opt out at any time via the unsubscribe link or by emailing contact@bookify.digital.

3. Purchases

If you purchase any product or service through the Service, you may be asked for billing details (e.g., card number, expiry, billing address). You represent and warrant that you have the legal right to use the payment method and that the information you provide is true and complete.

We may use third-party processors to facilitate payments. By submitting information, you grant us the right to provide it to these third parties subject to our Privacy Policy.

We may refuse or cancel orders for reasons including product/service availability, errors, suspected fraud, or unlawful transactions.

4. Contests, Sweepstakes and Promotions

Promotions may be governed by separate rules. If Promotion rules conflict with these Terms, the Promotion rules apply.

5. Free Trial

Bookify offers a free trial for three months (“Free Trial”). No fees are charged during the Free Trial. When the Free Trial ends, Service access for providers stops unless you subscribe to a paid plan.

Trial eligibility: One Free Trial per business/entity. We may deny or end a trial if we detect misuse or duplicate accounts.

6. Subscriptions

Service providers are billed on a subscription basis (“Subscription”). Plans and pricing vary by tier. Your access ends when the plan expires or is cancelled. You can renew at any time.

We may offer promotional pricing; such pricing may convert to standard rates upon renewal as displayed at checkout.

7. Fee Changes

We may modify Subscription fees. Changes take effect at the next billing cycle. We will provide reasonable prior notice so you may cancel before the change.

9. Content

Our Service allows you to post, store, and share content (“Content”). You are responsible for your Content’s legality and appropriateness. By posting Content, you warrant you have the rights to do so and grant us a license to host, display, and distribute it in connection with the Service.

We may monitor, edit, or remove Content that violates these Terms. Content on the Service is the property of Bookify or used with permission and may not be reused without written consent.

10. Prohibited Uses

You may use the Service only for lawful purposes. You agree not to:

• Violate applicable laws or regulations; exploit or harm minors; impersonate others; infringe rights; upload malware; disrupt Service operation.
• Scrape, crawl, or use bots without permission; attempt unauthorized access; conduct denial-of-service attacks.

11. Prohibited Businesses & Services

Providers may not use the Service for activities that are illegal or require licensing without holding such license. Examples include (non-exhaustive): illegal products; adult/explicit services; gambling; unlicensed financial services; pyramid schemes; weapons; controlled substances; medical, legal, or therapeutic services without required credentials/permits; counterfeit goods; fraudulent or misleading practices.

We may request proof of eligibility or licensing and suspend or remove accounts that violate this section.

12. Analytics

We may use third-party providers to monitor and analyze Service usage.

13. No Use By Minors

The Service is intended for individuals at least eighteen (18) years old.

14. Accounts

When you create an account, you must be 18+ and provide accurate, current information. You are responsible for safeguarding your credentials and for all activity under your account.

Service Provider Eligibility (including Home Businesses)

We accept home businesses in addition to registered companies. To protect customers and reduce fraud, we may require identity verification and business vetting before enabling bookings or payouts.

• Verification (KYC): You agree to provide a valid government ID (e.g., Oman Civil ID or passport) and any additional documents we reasonably request (e.g., selfie verification, proof of address, bank account proof, social profiles, permits/licenses where applicable).
• Accuracy: All information you submit must be true and kept up to date. We may suspend or refuse Service if verification fails or is not completed.

15. Marketplace Role, Payments, Payouts & Chargebacks

Bookify provides technology that allows customers to discover and book services from independent providers (“Providers”). Unless explicitly stated, Bookify is not the seller of the Provider’s services and does not assume responsibility for the performance of those services.

• Payments: Customer payments may be processed by third-party payment processors. Fees may be deducted prior to payout.
• Payouts: Where we facilitate payouts (including for home businesses without commercial registration), disbursements are made to the verified bank account on a schedule we communicate (typically weekly) and may be delayed for risk review, refunds, or chargebacks. We may apply minimum payout thresholds or rolling reserves.
• Chargebacks & Disputes: Providers are liable for chargebacks, refunds, or adjustments related to their customers. We may offset such amounts against future payouts or invoice you for the balance.
• Taxes & Invoices: Providers are solely responsible for determining, collecting, reporting, and remitting any taxes, fees, or duties arising from their services.

16. Service Standards, Cancellations & No-Shows

• Provider Obligations: Deliver services as described, on time, and with appropriate care, hygiene, and safety (including for in-home services).
• Policies: Providers must clearly state their cancellation/no-show policies. If not stated, customers may be entitled to a reasonable refund per applicable law and our fair-use rules.
• Rescheduling: If a Provider must reschedule, they should offer reasonable alternatives or refunds where appropriate.

17. Intellectual Property

The Service and its original content (excluding user Content) are and will remain the exclusive property of Bookify and its licensors. Our trademarks may not be used without prior written consent.

18. Copyright Policy

We respect intellectual property rights. If you believe Content on the Service infringes your rights, email contact@bookify.digital with the subject “Copyright Infringement” and include details per the DMCA or applicable law.

19. Error Reporting and Feedback

By providing feedback to Bookify, you grant us an irrevocable, royalty-free license to use it. Feedback is non-confidential.

20. Links To Other Websites

We are not responsible for third-party websites or services linked from the Service. Review their terms and privacy policies.

21. Disclaimer Of Warranty

The Service is provided “as is” and “as available” without warranties of any kind, to the maximum extent permitted by law.

22. Limitation Of Liability

To the fullest extent permitted by law, Bookify will not be liable for indirect, incidental, special, consequential, or punitive damages. Our aggregate liability is limited to the amount you paid to use the Service in the 12 months preceding the claim.

23. Termination

We may suspend or terminate accounts for any breach of these Terms or risk/fraud concerns. Upon termination, provisions that by nature survive will continue (e.g., ownership, disclaimers, limitations of liability, indemnity).

24. Reviews & Ratings

Users may submit reviews or ratings. Reviews must be genuine and based on actual experience. We may remove reviews that are abusive, fraudulent, or irrelevant. Providers may not incentivize, manipulate, or post fake reviews.

25. API, Integrations & Security

If you access webhooks, APIs, or integrations, you must keep keys and secrets confidential, use them only as documented, not exceed rate limits, and not compromise Service security. You are responsible for actions taken using your credentials.

26. Data Protection

We process personal data in accordance with our Privacy Policy. Providers must handle customer data lawfully, only for the intended booking purpose, and must not sell or misuse such data.

27. Fair Use & Anti-Abuse

We may throttle, suspend, or terminate accounts that abuse trials, send spam, create duplicate listings, or otherwise harm the platform or its users.

28. Governing Law

These Terms are governed by the laws of Oman, without regard to conflict-of-law principles.

29. Changes To Service

We may withdraw or amend the Service in our discretion without notice. We are not liable if any part of the Service is unavailable at any time.

30. Amendments To Terms

We may amend these Terms by posting updated terms on this page. Continued use after changes take effect constitutes acceptance.

31. Waiver And Severability

No waiver of any term is a further or continuing waiver of that term or any other term. If any provision is invalid or unenforceable, the remaining provisions remain in full force.

32. Acknowledgement

By using the Service, you acknowledge that you have read these Terms and agree to be bound by them.
